Unified International Liability Declaration & Agreement

This document governs your use of EBISbank, EBUID, and the Genometric Identity System. By creating an account, generating a Genometric ID, uploading or submitting information or documents, or using any related services, you enter into a legally binding agreement with EBIS Next Generation ID Limited.

1. Information Accuracy and Truthful Disclosure

You represent and warrant that all information and documents you submit are true, accurate, current, and complete. This includes, without limitation, personal details, identity documents, corporate records, financial statements, certificates, and any supporting material.

You acknowledge that providing incomplete, misleading, or inaccurate information may constitute a civil or criminal offence in one or more jurisdictions and may result in the immediate restriction, suspension, or termination of your access to EBISbank and related services.

1.1 Prohibition of Forged or Fraudulent Documents

You expressly undertake that you will not upload, submit, or use:

• Forged, falsified, altered, or tampered documents
• Documents obtained without authorization from their rightful owner
• Identity information that belongs to another person without full lawful authority
• Certificates or declarations that you know, or ought reasonably to know, are false

You understand and accept that EBIS Next Generation ID Limited may, at its sole discretion and where required or permitted by law:

• Refuse, suspend, or terminate your account or access to services
• Block or delay transactions and identity processes
• Retain and record relevant data for audit, regulatory, and legal purposes
• Report suspected fraud or criminal conduct to competent authorities or partners

2. Ethical, Moral, and Cultural Responsibility

You acknowledge that identity, biometric, and genomic data are highly sensitive. You agree to act with integrity, good faith, and respect for others whenever you access, view, use, share, or request data through EBISbank, EBUID, or the Genometric Identity System.

2.1 Individual Conduct

You agree that you will not use the platform to:

• Harass, discriminate against, or harm any person or group
• Promote hatred, violence, or content that is racist, xenophobic, or otherwise abusive
• Violate accepted standards of public order, morality, or decency in relevant jurisdictions
• Disrespect cultural, religious, or social sensitivities when communicating or handling data

2.2 Use of Data

You agree to use any personal, biometric, genomic, or identity-related data accessed through the platform only for lawful, explicitly authorized purposes. You must respect:

• Human dignity and privacy rights
• Applicable data protection and non-discrimination laws
• Contractual and regulatory duties between you and third parties

You accept that unethical, abusive, or discriminatory use of data may result in immediate suspension or termination of access, notification to relevant authorities or partners, and potential civil or criminal liability.

3. Legal Basis and Data Processing

Processing of your data is carried out under one or more lawful bases, including consent, contractual necessity, legitimate interests, and compliance with legal obligations, in accordance with GDPR, the UK Data Protection Act 2018, and any other applicable data protection laws.

Immutable records on distributed systems are designed to preserve integrity without exposing raw personal, biometric, or genomic data on public blockchains. Such sensitive data remain within controlled, encrypted processes under a privacy-by-design framework.

You retain rights of access, rectification, restriction, and deletion where legally permissible and subject to technical and regulatory constraints, as further detailed in the Privacy Policy and GDPR notices.

4. Identity Utility, Not Investment

EBUID is an identity utility token. It does not represent shares, equity, debt, or any regulated financial instrument. It is not an investment product and does not grant profit rights, dividends, or ownership in EBIS Next Generation ID Limited.

5. Blockchain Risk Acceptance

You understand that blockchain networks are independent and decentralized. EBIS Next Generation ID Limited does not control their operation. You accept all risks associated with blockchain use, including but not limited to:

• Network congestion, delays, or failures
• Protocol changes, forks, or attacks
• Irreversibility of on-chain transactions

6. Responsibility for Keys and Wallets

You are solely and fully responsible for the security of your wallets, private keys, recovery phrases, and any associated credentials. EBIS Next Generation ID Limited cannot restore or reverse loss arising from compromised or lost keys or unauthorized access to your wallet.

7. Limitation of Liability

To the maximum extent permitted by applicable law, EBIS Next Generation ID Limited, its directors, officers, employees, agents, and affiliates are not liable for any direct or indirect loss, damage, cost, or claim arising from:

• Your use or inability to use EBISbank, EBUID, VaultID, or the Genometric Identity System
• Any blockchain failure, fork, bug, or protocol change
• Loss, theft, or misuse of your keys, wallets, or credentials
• Third-party integrations, platforms, or service providers
• Your submission of forged, falsified, or unauthorized documents or information
• Any unethical, unlawful, or culturally disrespectful use of data by you or under your credentials

8. Indemnity

You agree to indemnify, defend, and hold harmless EBIS Next Generation ID Limited from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your breach of this Liability Agreement or any other applicable terms
• Your submission of forged, falsified, or misleading documents or information
• Your misuse of identity, biometric, or genomic data
• Your violation of applicable laws, regulations, or third-party rights

9. Confirmation of Legal Documents

By creating or continuing to use your account, you confirm that you have read, understood, and agree to the following, as amended from time to time:

10. Final Acknowledgment

By submitting this acknowledgment, you confirm that you understand and accept:

• Your full responsibility for the authenticity and lawfulness of all documents and information uploaded
• Your ongoing ethical, moral, and culturally respectful duties when using the platform and its data
• The limitations of liability and risk allocation described in this Agreement
